INTERPRETATION AND DEFINITIONS

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

1.2(d) ‘Damages´ means compensation in terms of money for the loss suffered by the injured party.
1.2(e)“Device” means any device that can access the Service such as a computer, a cell phone, or a digital tablet.
1.2(f)“Feedback” means feedback, innovations, or suggestions sent by You regarding our Service's attributes, performance, or features.
1.2(g) “Terms and Conditions” (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between buyer and the Company.
2) GOVERNING LAWS
Any disputes relating to this agreement shall be governed by the laws of India, and M/S BISJHINTUS PRIVATE LIMITED and the purchaser hereby submit to the exclusive jurisdiction and venue of the courts located in Mangalore (Karnataka). Any other venue to which any party may be entitled by virtue of domicile or otherwise is waived by both parties.
2.1 Dispute Resolution
2.1.1 If You have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting the Company.
3) OBLIGATIONS OF CLAUSE
3.1 The buyer must make sure that every detail in a purchase is accurate and complete. If the purchase is accepted or not after we receive it, whether it was placed online or off, we will let you know by email or in writing.
3.2 A contract between the buyer and M/S BISJHINTUS PRIVATE LIMITED has been established as a result of our acceptance of the transaction. There shall be no contract established without a written or electronic proof.
3.3 The terms of a contract shall be binding upon both the buyer and M/S BISJHINTUS PRIVATE LIMITED, and the buyer shall not be permitted to modify such contract in any manner.
3.4 In accordance with the terms of the contract, the buyer must make payments on time. If the buyer pays after the due date, M/S BISJHINTUS PRIVATE LIMITED may impose a penalty.
3.5 The buyer is supposed to read all our policies related to the interest of agreement before indulging himself to the contract.
4) USE OF PROHIBITED ACTIVITIES
4.1 Purchaser shall not involve any third party in the agreement which is not a part of the agreement.
4.2 The purchaser shall not misrepresent or conceal any fact while making the contract.
5) INDEMNIFICATION CLAUSES
The Company shall indemnify, defend, and hold harmless against any liability, damage, loss, or expense (including reasonable attorneys fees and expenses of litigation) incurred by or imposed upon any of the M/S BISJHINTUS PRIVATE LIMITED in connection with any third party claims, suits, actions, demands or judgments (“Claims”) under any theory of liability (including without limitation actions in the form of tort, warranty, or strict liability) resulting from or arising out of the practice by the Company, its Affiliates or any of their Sublicensees, or concerning any process, or service that is made, used, or sold pursuant to any right, to the Company under this Agreement, other than in the event of a Claim resulting from or arising out of a breach of the representations and warranties under this Agreement.
6) LOSS OR DAMAGE OF THE PRODUCT CLAUSE
6.1) The party who suffers harm due to a contract violation may file a lawsuit to recover damages.
6.2) In case of breach of contract, the aggrieved party is only entitled to recover such part of the loss actually resulting as was at the time of the contract reasonably foreseeable as liable to result from the breach.
7) THIRD PARTY
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
Provided that, The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. 8) MINOR

B) If you are a parent or legal guardian of a minor, you hereby agree to bind the minor to these terms and to fully indemnify and hold harmless the company if the minor breaches any of these terms.

9.1 Any intellectual property or intellectual property rights of M/S BISJHINTUS PRIVATE LIMITED may be violated, attempted to be violated, provided to someone to violate, or assisted in violating by the purchaser. Therefore, we could move appropriately against the buyer.
9.2 If the buyer misuses any part of the agreement. M/S BISJHINTUS PRIVATE LIMITED may take the appropriate action against the buyer.
10) DISCLAIMER OF WEBSITE
10.1 To the fullest extent permitted by applicable law, M/S BISJHINTUS PRIVATE LIMITED and its directors, employees, content providers, agents, and affiliates hereby disclaim all warranties, express or implied, including, without limitation, any implied warranties of merchantability, satisfactory quality, or fitness for a particular purpose with respect to this Site and its content.
10.2 M/S BISJHINTUS PRIVATE LIMITED uses reasonable efforts to ensure the accuracy, correctness and reliability of the content, but we make no representations or warranties for the same. 14) LIMITATION OF LIABILITY
14.1 Notwithstanding any damages that purchaser might incur, the entire liability of the Company and any of its suppliers under any provision of this agreement.
14.2 To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability by, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
14.3 Some of the aforementioned restrictions might not be applicable because some states do not allow the exclusion of implied warranties or the reduction of liability for incidental or consequential losses. The maximum extent allowed by law will be applied in these states to limit each party's liability.
14.4 M/S BISJHINTUS PRIVATE LIMITED is not responsible for any losses suffered by the buyer in any way unless those losses are the result of the company's negligence.
15) TERMINATION OF CLAUSES
15.1 We may terminate or suspend the agreement immediately, if You breach any clause of agreement.
15.2 The company has the right to terminate the agreement in those cases where the buyer does or tries to do or abet the other person for doing any type of fraud,coerced and misrepresentation for anything whether it's personal or professional.
15.3 The Purchaser can terminate or cancel the goods order within 3 days of placing the order with cancellation charges.
15.4 The company has the right to terminate or suspend the agreement in the case of not receiving payment within the agreed time period.
16) SEVERABILITY
If any provision of the agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
17) FORCE MAJEURE
If the force majeure affects the performance of the contract, the party that is subject to force majeure shall promptly notify the other party and submit to the other party a sufficient and valid proof of force majeure within a reasonable period after the end of force majeure. Otherwise, the corresponding liability shall not be waived.
18) WAIVER CLAUSE
Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
19) MODIFICATION
These terms and conditions may be amended or modified at any moment by Bisjhintus, and such modifications shall take effect as soon as they are posted on our website. We will let you know about the modification.
20) SERVICES
We always commit to giving our users the best service but in the case of any damages done by any unaffiliated party, M/S BISJHINTUS PRIVATE LIMITED will not be liable for this.
21) COMPANY RIGHTS
21.1 In the event that payment is not made within the predetermined time period, the business has the right to cancel or suspend the agreement.
21.2 If the buyer commits, attempts to commit, or aids another person in committing any type of fraud, coercion, or misrepresentation for anything—whether it's personal or professional—the company has the right to end the agreement.
22) GUIDELINES FOR USER
22.1 When conducting any online or offline transaction involving credit cards, debit cards, or other types of instruments or documents for making such transactions, the User shall be solely responsible for maintaining the confidentiality of the User password and user identification, as well as all activities and transmissions carried out by the User through his user identification. M/S BISJHINTUS PRIVATE LIMITED assumes no responsibility or liability for their imprecision.
22.2 M/S BISJHINTUS PRIVATE LIMITED shall not be responsible for any loss or damage resulting from any disclosure (inadvertent or otherwise) of information relating to or regarding online transactions using credit cards or debit cards and/or their verification process and particulars as well as for any error, omission, or inaccuracy with respect to any information so disclosed and used, whether or not in compliance with a legal requirement.
22.3 The user is not permitted to save or obtain any data from a computer system with the intention of violating the rights to someone else's intellectual property.
22.4 The user agrees not to defame or intentionally cause injury to the other party's reputation, either through oral or by written communication.
23) GENERAL PROVISION
23.1 All agreements made between the merchant (Purchaser) and M/S BISJHINTUS PRIVATE LIMITED (including any that the merchant may attempt to impose through discussion, negotiation, or other course of dealing) shall be governed solely by the terms and conditions set forth in this document.
23.2 No order submitted by the buyer shall be considered to be accepted by the company until the company issues a written acknowledgement of order.
23.3 In the cases of conflict between the said parties related to any order then these terms and conditions shall prevail on that order.
23.4 Despite not routinely doing so, M/S BISJHINTU'S PRIVATE LIMITED retains the right to look over your website postings. However, We will take whatever action it considers appropriate in its sole discretion if it learns of the improper use of our website or any of its Services. You agree that M/S BISJHINTUS PRIVATE LIMITED will have the right to report any actions that could be regarded as illegal, as well as any information it obtains about such illegal behaviour, to law enforcement officials. M/S BISJHINTUS PRIVATE LIMITED will completely cooperate with law enforcement authorities upon request in any investigation into alleged illegal Internet behaviour.
24) PAYMENT CLAUSES
24.1 The payment mode accepted by the company is either through net banking or any other online mode which is acceptable by the company.
24.2 If the purchaser does not fulfil his promise to make payment within the agreed period of time, the company is entitled to cancel the agreement and claim damages for losses directly or indirectly from the purchaser.
25) REFUND POLICY

29) PRIVACY POLICY
